Will Smith is facing renewed legal scrutiny after explosive claims from a former tour musician ignited a serious courtroom battle. 

The Oscar-winning actor has been sued by Brian King Joseph, who alleges sexual harassment and wrongful termination during Smith’s Based on a True Story: 2025 tour. 

While Smith has firmly denied the accusations, the lawsuit outlines a series of events that Joseph claims left him emotionally, professionally, and physically damaged.

Will Smith has been named in a lawsuit filed by Brian King Joseph, a violinist who performed during the actor’s Based on a True Story: 2025 tour. 

Joseph, who gained national recognition as a top-three finalist on “America’s Got Talent” in 2018, claims his professional relationship with the 57-year-old began after he played for the star at his home in November 2024.

According to court documents reviewed by the Daily Mail, Joseph was then hired to perform at Smith’s December 2024 concert in San Diego and later joined the full tour. 

During this time, he also performed on the “Fresh Prince of Bel Air” star’s album “Based on a True Story.” 

Joseph alleges the two grew close over the course of their working relationship, spending what he described as “additional alone time” together.

At one point, the violinist claims Smith told him, “You and I have such a special connection that I don’t share with anyone else.” 

The lawsuit alleges that this closeness later became the foundation for what Joseph describes as inappropriate behavior.

Smith’s Accuser Describes Chilling Hotel Room Incident

According to the lawsuit, a major turning point occurred on March 20, 2025, during the first leg of the tour in Las Vegas. 

Joseph alleges he returned to his hotel room around 11 p.m. and discovered it had been “unlawfully entered” by an “unknown person.” 

Although hotel security reportedly found no signs of forced entry, Joseph says the room had clearly been disturbed.

Inside, he allegedly found a handwritten note that read, “Brian, I’ll be back no later [sic] 5:30, just us,” accompanied by a heart and signed “Stone F.” 

The lawsuit further alleges that the note was left alongside several personal items, including “wipes, a beer bottle, a red backpack, a bottle of HIV medication with another individual’s name, an earring, and hospital discharge paperwork belonging to a person unbeknownst to Plaintiff.”

Joseph says the discovery terrified him. According to court filings, he feared that someone would “return to his room to engage in sexual acts” with him.

Following the incident, Joseph says he immediately contacted hotel security, a non-emergency police line, and Smith’s management team. 

He also took photographs of the items left in the room and requested a room change. Joseph maintains that his concerns were strictly about safety.

In the lawsuit, he states that he “made clear that his only concern was safety and that he did not wish to receive any special treatment or compensation.” 

According to him, at no point did he seek financial benefit or special favors as a result of reporting the incident.

The suit also emphasizes that hotel room access details were shared via a spreadsheet given to the band and crew, arguing that only “crew and hotel staff would have had access to Plaintiff’s hotel room.” 

This detail is used to support Joseph’s claim that the entry was not random or accidental.

Days after reporting the alleged incident, Joseph alleges he was confronted by a member of tour management. 

According to his court documents, that individual allegedly “shamed” him and placed blame directly on him for what happened.

The 32-year-old alleges the manager told him, “Everyone is telling me that what happened to you is a lie, nothing happened, and you made the whole thing up. So, tell me, why did you lie and make this up?” 

Shortly afterward, Joseph says he was fired from the tour and replaced. 

Joseph alleges that the situation supports the claim that Smith was “deliberately grooming and priming Mr. Joseph for further sexual exploitation.”

Smith has denied all allegations through his attorney, Allen B. Grodsky. 

In a statement to the Daily Mail, Grodsky said, “Mr. Joseph’s allegations concerning my client are false, baseless, and reckless.” 

He added, “They are categorically denied, and we will use all legal means available to address these claims and to ensure that the truth is brought to light.”

Meanwhile, Joseph claims the fallout from his firing led to a serious decline in his health. 

Court documents state that the stress resulted in “major physiological damage” and that he “suffered from PTSD and other mental illness as a result of the termination.”

Joseph officially filed the lawsuit this week in the Superior Court of California, County of Los Angeles, and is demanding a jury trial. 

As the case moves forward, the allegations threaten to place Will Smith back under intense public and legal scrutiny.
