Erika Jayne Breaks Silence On Reason Tom Girardi Divorce Is Stalling

Erika Jayne is putting the delay behind her divorce from Tom Girardi into perspective.
The reality star has explained that the reason why the pause button on her divorce process has been activated hinged majorly on her estranged husband’s health and the legal loopholes involved in finalizing the process.

The Bravo star, during her appearance on “Watch What Happens Live” on Thursday, shared deeper insights into burning questions from fans about why she had yet to pull through with her divorce.
She explained that while she has indeed filed for divorce and is currently separated from her ex, his battle with Alzheimer’s disease has gotten in the way of things moving forward.
According to her, her ex-husband has been placed under a conservatorship for about four years now, and every paperwork involved in the process has to go through the conservator.
Expressing her frustration, Jayne stated, “It's very difficult to get someone who's incompetent to divorce. I have to ask the conservator. It's just not that easy. You guys, just stop with all that.”
Aside from his conservatorship and the disease, Girardi is also currently serving a seven-year prison sentence after he was found guilty of embezzling over $15 million from law firm clients.
When Cohen asked if Jayne had ever thought about checking on him in prison, the TV star answered in the affirmative, but noted that she did not act on it. “It's too much. That's enough. Everything he's done. Like, it is what it is,” Jayne explained to Cohen.

Looks like Jayne’s answers spurred more curiosity and a broad discussion among fans who drew up several more reasons why Jayne is dragging her feet.

A lot has happened since Girardi’s incarceration, and that includes Jayne getting into a new relationship with a retired US Army officer. As shared by The Blast, the “Real Housewives of Beverly Hills” star opened up about her love life on a July episode of her podcast “Diamonds In The Rough.”
Jayne, alongside her co-star, Teddi Mellencamp, got into a deep discussion about US Army special operations sergeant major John McPhee, whom she nicknamed “Shrek.” The TV star explained that they met through her pal from “The Hills,” Heidi Montag.
She affirmed that McPhee and Montag had worked together for a while as she served as a security personnel to their family and a godfather to their son, Gunner. Jayne recalled walking up to him at an event in London where he was working as Montag’s bodyguard and introducing herself.
She shared that she picked up from his face from his podcast appearance and revealed to him how much of a fan she is. Jayne’s romance with McPhee was largely hush-hush until the media uncovered his identity after he was spotted getting hot and heavy with the reality star on a date.

Jayne and the disgraced attorney were married for about two decades, and when his case blew up, the reality star affirmed she knew it was time to go. Despite the certainty that her marriage to Girardi was over, the media personality noted that it was still very tough to file for divorce.
The Blast stated that the TV star even confessed in an episode of the Bravo show that she was heartbroken about his incarceration and hoped he would die rather than go through the shame of serving time.
She added that it felt terrible seeing the person she shared 20 years of her life with serving out a prison sentence, which may likely end with his death behind bars.
“To see him walk down the courtroom steps like that, knowing he's going to die in prison, that's heavy on any level,” the star confessed to her “RHOBH” co-star, Sutton Stracke.

Jim Wilkes, the attorney who represented Jayne, voiced his thoughts on Girardi’s journey to jail and how he probably deserved it despite his battle with dementia. He did not mince words on confirming that the convicted attorney is indeed down with the cognitive disease.
He noted that while he was not happy with the fate of Girardi, whom he once shared a personal and professional relationship with, his sentencing was right on track.
“You have to deal with the consequences. The system is not perfect, but I'm sure he'll be in minimum security as he's no threat, but prison is still prison,” Wilkes stated.
Girardi was found guilty on four counts of wire fraud in August 2024 and was sentenced to 87 months in prison this year, alongside an order to pay a $35,000 fine and $2,310,247 in restitution.
